POLÍTICAS DE PRIVACIDAD

En cumplimiento a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares vigente en toda la República Mexicana, la cual tiene por objeto la protección de los datos personales en posesión de los particulares, con la finalidad de regular su tratamiento legítimo, controlado e informado, a efecto de garantizar la privacidad y el derecho a la autodeterminación informativa de las personas,C MANAGEMENT, S.A. DE C.V., con domicilio en: Av. Coyoacan 1050, Del Valle Centro, Alcaldia Benito Juarez , CDMX , en la Ciudad de México, extiende el presente para dar cumplimiento a lo establecido a la citada ley y demás normativas aplicables, para regular e informar a las personas físicas y morales que otorgan el consentimiento expreso o tácito al tratamiento de sus datos personales, los términos y las condiciones que conforman el presente aviso de privacidad.

1. ¿Qué información recopilamos?

Los datos personales que usted libre y voluntariamente proporcione a C MANAGEMENT, S.A. DE C.V., podrán incluir de manera enunciativa más no limitativa su: nombre, domicilio, dirección de correo electrónico (e-mail), números telefónicos, fecha de nacimiento, nacionalidad; y para los procedimientos de selección y contratación, podremos incluir también formación profesional y académica, experiencia laboral, así como referencias personales para fines de consulta por parte de C MANAGEMENT, S.A. DE C.V., manifestando que bajo ningún concepto y bajo ninguna excepción se recabarán datos personales considerados como sensibles, lo anterior en fundamento con el artículo 3 fracción VI de la ley en materia, entendiéndose como datos sensibles aquellos datos personales que afecten a la esfera más íntima de su titular o cuya utilización indebida pueda dar origen a discriminación o conlleve un riesgo grave para éste. Particularmente se consideran sensibles aquellos que puedan revelar aspectos como origen racial o étnico, estado de salud presente y futura, información genética, creencias religiosas, filosóficas y morales, afiliación sindical, opiniones políticas, preferencias sexuales.

2. ¿Para qué utilizamos su información?

Los datos personales que recopilamos los destinamos únicamente a los siguientes propósitos: (a) fines de identificación, (b) fines estadísticos y de análisis interno, (c) fines de información y contacto, (d) información a clientes, (e) reclutamiento y selección de personal, y/o, (f) fines comerciales, (g) para eventualmente contactarlo vía correo electrónico en relación a los fines antes mencionados. En la recolección y tratamiento de datos personales que de manera expresa que le solicite, nos mantenemos en la observancia de los principios de licitud, calidad, consentimiento, información, finalidad, lealtad, proporcionalidad y responsabilidad, lo anterior en fundamento con el artículo 6 de la ley en materia.

Para las propuestas enviadas a los clientes y derivadas de relaciones comerciales, la información proporcionada será utilizada para proveer los servicios y productos que ha solicitado, informarle sobre cambios en los mismos, evaluar la calidad del servicio que le brindamos, envío personalizado de materiales de difusión, promoción, alguna publicidad o bien algún material consistente en la realización de un trabajo a ejecutar como resultado de una prestación de servicios.

El contenido de las encuestas que se pudieran utilizar para el desarrollo de la prestación de servicios profesionales se basa en recabar información derivada de una serie de preguntas con respuestas de opción múltiple que permite alimentar estudios de estadística necesarios para la integración del proyecto a ejecutar por parte de C MANAGEMENT, S.A. DE C.V.

Para las finalidades antes mencionadas, requerimos obtener sólo datos basados en su ámbito comercial, pues en ningún concepto se recabarán datos considerados personales o sensibles, en fundamento en la Ley Federal de Protección de Datos Personales en Posesión de los Particulares. Para efectos de Cualquier información que pudiera intercambiarse sin ser solicitados de manera expresa por C MANAGEMENT, S.A. DE C.V. ., ya sea hacia un tercero o hacia él mismo, C MANAGEMENT, S.A. DE C.V. , no está obligado a ningún tipo de tratamiento u observancia establecida en la ley en comento, por lo que no se hace responsable del tratamiento que se le brinde a dichos datos ni la difusión de los mismos.

Respetamos los principios rectores de la Protección de Datos Personales, integrados en nuestros valores empresariales, sin buscar y/o obtener fines de lucro, sin el afán de molestarle o poner en peligro sus datos, bienes o persona, sino como un servicio de difusión y promoción de los servicios que proporcionamos y/o eventos que organicemos.

3. ¿Con quién compartimos su información?

C MANAGEMENT, S.A. DE C.V. podrá contratar a uno o varios terceros para manejar y administrar tanto el Portal en Internet, (proximamente) como los datos personales que se recaban a través de éste o de cualquier otro medio distinto, por lo que podría incluso transferirlos a dicho(s) tercero(s) sin un fin comercial, sino únicamente para cumplir con la prestación de los servicios contratados. De igual manera C MANAGEMENT, S.A. DE C.V. Podrá sin fines ilícitos o de lucro, compartir o transmitir sus datos personales para los mismos fines establecidos en el numeral 2. En ningún caso comercializaremos, venderemos o rentaremos datos personales.

Los datos personales que usted proporcione a C MANAGEMENT, S.A. DE C.V. Podrán compilarse y fijarse en una base de datos propiedad exclusiva de C MANAGEMENT, S.A. DE C.V.

4. ¿Qué medidas de seguridad y control utilizamos para la protección de sus datos personales?

C MANAGEMENT, S.A. DE C.V. tiene implementadas medidas de seguridad administrativa, técnicas y físicas para proteger sus datos personales en todo momento con los lineamientos y requerimientos establecidos en la Ley. Todo tratamiento de datos personales estará sujeto al consentimiento de su titular, salvo las excepciones previstas por la ley en la materia. El consentimiento será expreso cuando la voluntad se manifieste verbalmente, por escrito, por medios electrónicos, ópticos o por cualquier otra tecnología o por signos inequívocos. Se entenderá que el titular consiente tácitamente el tratamiento de sus datos, cuando habiéndose puesto a su disposición el aviso de privacidad no manifieste su oposición.

5. ¿Cómo puede usted ejercer sus derechos ARCO?

Los usuarios titulares de datos personales podrán ejercitar los derechos ARCO (acceso, cancelación, rectificación y oposición al tratamiento de sus datos personales), enviando directamente su solicitud a través de la cuenta de correo electrónico: administracion@cpma.mx cuyo responsable designado especialmente por C MANAGEMENT, S.A. DE C.V. atenderá las solicitudes que realicen los usuarios relacionadas con el tratamiento de datos personales. Dicha solicitud deberá contener por lo menos: I.- Nombre y domicilio, correo electrónico u otro medio para comunicarle la respuesta a su C MANAGEMENT, S.A. DE C.V. solicitud; II.- Los documentos que acrediten la identidad del usuario o, en su caso, la representación legal de quien actúe en su nombre; III.- La descripción clara y precisa de los datos personales respecto de los que se solicita ejercer alguno de los derechos ARCO; IV.- Cualquier otro elemento que facilite la localización de los datos personales, y V.- las modificaciones a realizarse en caso de que la solicitud sea para la rectificación de Datos Personales.

6. ¿Cuándo puede usted ejercer sus derechos ARCO?

En términos de la Ley en materia a partir del 6 de enero de 2012 y en todo momento, usted podrá presentarnos una solicitud para ejercer sus derechos ARCO; C MANAGEMENT, S.A. DE C.V., comunicará al titular en un plazo máximo de 20 días contados desde la fecha en que se recibió la solicitud de Acceso, Rectificación, Cancelación u oposición a la determinación adoptada a efecto de que, si resulta procedente, se haga efectiva la misma dentro de los 15 días siguientes a la fecha en que se comunica la respuesta. Si transcurrido el término que señala la Ley, C MANAGEMENT, S.A. DE C.V. no diera respuesta a su solicitud, entonces podrá iniciar el procedimiento de protección de derechos ARCO ante el Instituto Federal de Acceso a la Información y Protección de Datos Personales (IFAI).

7. Modificaciones al Aviso de privacidad

Nos reservamos el derecho de cambiar el presente Aviso de Privacidad en cualquier momento. En caso de que exista algún cambio en el presente Aviso de Privacidad. Por su seguridad, consulte en todo momento que así lo desee el contenido de este aviso de privacidad C MANAGEMENT, S.A. DE C.V. se reserva el derecho a denegar o retirar el acceso al Servicio, en cualquier momento y sin necesidad de aviso previo, a aquellos Usuarios que incumplan las Condiciones Generales establecidas por la ley en la materia.

8. Otras normatividades aplicables.

C MANAGEMENT, S.A. DE C.V. . se encuentra ubicada en México y todos los asuntos en relación el presente aviso legal es regidos por las leyes de México. Si usted está ubicado en algún otro país distinto de México y nos contacta, por favor tome en cuenta que cualquier información que Usted nos provea será transferida a México, y al momento de ingresar su información Usted autoriza esta transferencia y la aceptación del presente aviso legal.

1. What information do we collect?

3. With whom do we share your information?

C MANAGEMENT, S.A. DE C.V.,. has implemented administrative, technical and physical security measures to protect your personal data at all times with the guidelines and requirements established in the Law. All processing of personal data will be subject to the consent of its owner, except for the exceptions provided by law in the matter. 5. How can you exercise your ARCO rights?

Users who own personal data may exercise their ARCO rights (access, cancellation, rectification and opposition to the processing of their personal data), by sending their request directly through the email account: administracion@cpma.mx whose person is specially designated by C MANAGEMENT, S.A. DE C.V., will attend to the requests made by users related to the processing of personal data. Said request must contain at least: I.- Name and address, email or other means to communicate the response to your C MANAGEMENT, S.A. DE C.V., request; II.- The documents that prove the identity of the user or, where appropriate, the legal representation of whoever acts on their behalf; III.- The clear and precise description of the personal data with respect to which it is requested to exercise any of the ARCO rights; IV.- Any other element that facilitates the location of personal data, and V.- the modifications to be made in the event that the request is for the rectification of Personal Data.

6. When can you exercise your ARCO rights?

In terms of the Law on the matter as of January 6, 2012 and at any time, you may submit a request to us to exercise your ARCO rights; C MANAGEMENT, S.A. DE C.V., will notify the owner within a maximum period of 20 days from the date on which the request for Access, Rectification, Cancellation or opposition to the decision adopted was received so that, if appropriate, it becomes effective within 15 days following the date on which the response is communicated. If after the term indicated by the Law, C MANAGEMENT, S.A. DE C.V., does not respond to your request, then you can start the ARCO rights protection procedure before the Federal Institute for Access to Information and Protection of Personal Data (IFAI).

7. Modifications to the Privacy Notice

We reserve the right to change this Privacy Notice at any time. In case there is any change in this Privacy Notice. For your safety, consult the content of this privacy notice C MANAGEMENT, S.A. 8. Other applicable regulations.

C MANAGEMENT, S.A. DE C.V., is located in Mexico and all matters related to this legal notice are governed by the laws of Mexico. If you are located in a country other than Mexico and you contact us, please take into account that any information you provide us will be transferred to Mexico, and at the time of entering your information you authorize this transfer and the acceptance of this legal notice .
